Bharatiya Janata Party (BJP) Sadar MLA Major Sunil Dutt Dwivedi has been convicted of violating the Model Code of Conduct during the 2022 Uttar Pradesh Assembly elections.
The verdict was delivered on Friday by MP-MLA court judge Gyanendra Kumar, who sentenced the legislator to six months’ imprisonment and imposed a fine of Rs 3,200. The court added that failure to pay the fine would result in an additional one-month jail term.

The case pertains to an incident on January 27, 2022, when Dwivedi, then the BJP candidate from the Sadar Assembly seat, was accused of flouting COVID-19 guidelines and election protocols.
According to the complaint lodged by then Civil Lines outpost in-charge Anand Sharma, Dwivedi was accompanied by 30–35 supporters who raised slogans in his support as well as for the BJP party after filing his nomination papers.
The FIR mentioned that neither the candidate nor his supporters were wearing masks or following social distancing norms—constituting a violation of both COVID protocols and the Model Code of Conduct.
Following the investigation, a chargesheet was filed in the court. During the trial, Assistant Prosecution Officer (APO) Jitendra Singh presented arguments on behalf of the state, while the defense also submitted its case. After hearing both sides and reviewing evidence and witness testimonies, the court found Major Dwivedi guilty.Following the verdict, Dwivedi’s legal team submitted a bail application. The court granted him bail upon furnishing two surety bonds.
